Parliament to hear two petitions against Cherera four

The National Assembly’s Committee on Justice and Legal Affairs will this morning hear two petitions seeking the removal of the four dissenting Independent and Electoral Boundaries Commission (IEBC) commissioners.

The committee which began proceedings Thursday will later cross-examine the two petitioners Geoffery Langat and Steve Gerry Owour.

The MPs have already processed two petitions by the Republican Liberty Party and Rev. Dennis Ndwiga Nthumbi in a stormy session attended by Azimio top leadership and allied MPs in Parliament.

Azimio La Umoja One Kenya coalition leader Raila Odinga, Wiper Democratic Movement leader Kalonzo Musyoka and Martha Karua Thursday followed the proceedings in the mini-chambers as MPs laid the ground rules on how the hearings will be conducted.

Led by Minority Whip, Junet Mohammed, the leaders walked out after a ruling was made by a majority of the committee members upholding the jurisdiction of the committee to hear the matter.

Lawyers representing the four commissioners had raised preliminary objections over the committee’s authority to conduct the hearings.

The petitioners want the four IEBC commissioners Juliana Cherera, Julius Nyang’aya, Irene Massit, and Francis Wanderi kicked out from office on grounds of violation of the constitution and other laws; gross misconduct, and incompetence.

The officials disowned the presidential results announced by IEBC chair Wafula Chebukati terming them as opaque.

They have however been according to an opportunity to defend themselves next week Monday and Tuesday when they will appear before the committee.

According to the Constitution, IEBC commissioners can be removed from office through a petition in the National Assembly and a tribunal formed by the sitting President.
