Amnesty International is a global human rights organization dedicated to advocating for and protecting human rights worldwide. In Kenya, the organization has been instrumental in addressing various human rights issues, including police brutality, freedom of expression, and the right to peaceful assembly.
Between March and July 2023, Kenya witnessed a series of anti-government protests triggered by the high cost of living and alleged electoral malpractices following the August 2022 general elections. Amnesty International Kenya, in collaboration with Human Rights Watch, conducted extensive investigations into the government’s response to these protests. Their findings revealed that Kenyan police used excessive and unnecessary force against protesters and bystanders, resulting in numerous human rights violations. The report, titled “Unchecked Injustice: Kenya’s Suppression of the 2023 Protests,” documented that at least 31 people were killed during these demonstrations. The Independent Policing Oversight Authority (IPOA) later reported that the death toll was at least 67 during this period.
The documented abuses included the use of live ammunition, kinetic impact projectiles such as rubber bullets, and tear gas in residential areas and schools. Police conducted violent house-to-house operations, beating and shooting residents, and in some cases, killing them. The report also highlighted arbitrary arrests, detention, torture, and other ill-treatment of individuals, including children under 18. These actions violated fundamental human rights, including the right to life, peaceful assembly, freedom from torture, and human dignity, all of which are guaranteed by Kenya’s Constitution and international law.
Despite credible evidence from witnesses, media, and medical records, no police officers have been prosecuted for these grave violations. The lack of accountability has emboldened further violations, undermining public trust in law enforcement agencies. Amnesty International Kenya has been at the forefront of calling on the Kenyan government to acknowledge, condemn, and investigate these killings and the use of excessive force by police. The organization has urged the government to hold accountable those credibly implicated in abuses and to introduce credible police reforms to prevent future occurrences.
In addition to addressing police brutality, Amnesty International Kenya has been vocal about the government’s attempts to restrict the right to peaceful assembly. During the 2023 protests, the National Police Service refused to acknowledge several protest notifications and declared planned demonstrations illegal. The government attempted to further restrict the right to peaceful assembly by adding provisions to the Public Order Act, which undermined constitutional protections. Amnesty International has consistently advocated for the protection of the right to peaceful assembly and has condemned any attempts to curtail this fundamental freedom.
The organization has also been involved in addressing other human rights issues in Kenya. For instance, in March 2023, mass graves were discovered in Kilifi County containing the bodies of at least 428 people, including children. These deaths were attributed to leaders of the Good News International Ministries. Amnesty International called for thorough investigations into these deaths and for the perpetrators to be brought to justice.
Furthermore, Amnesty International has been monitoring the situation of LGBTI rights in Kenya. In 2023, there were threats to LGBTI people’s rights due to a proposed homophobic bill. The organization has been advocating against such legislation, emphasizing the need to protect the rights of all individuals, regardless of their sexual orientation or gender identity.
